Welcome to Portal Exchange (hereinafter “Portal Exchange”, “the Platform” or “we”), operated by PORTAL COMERCIAL SpA, RUT 78.290.568-6, with registered office at Santa Magdalena Nro. 75, Of. 304, commune of Providencia, Metropolitan Region.
These Terms and Conditions (hereinafter “T&Cs”) govern access to and use of our website www.portalexchange.cl and all services, tools and functionalities that we currently offer or may incorporate in the future (together, “the Services”).
By registering, browsing or using any of our Services, you declare that you have read, understood and fully accepted these T&Cs as well as our Privacy Policy. If you do not agree with any of the provisions, you must not use the Platform.
Portal Exchange is a digital space that connects students, interns and young workers (hereinafter “Tenant Users”) with accommodation owners (hereinafter “Landlord Users”), facilitating the search, dissemination and booking of rooms and activities for medium and long-term stays.
The Platform is not a party to the contractual relationships established directly between Landlords and Tenants. Our role is exclusively that of a technological intermediary, providing the tools for users to interact, publish, search and, where applicable, formalize bookings and contracts.
To use our Services, you must:
Be at least 18 years old.
Have sufficient legal capacity to contract and bind yourself.
Register an account providing truthful, complete and up-to-date information.
Maintain the confidentiality of your access credentials.
Landlord Users: by publishing an accommodation, you declare under your own responsibility that you are either the owner of the property or have the express authorization of the owner to sublet it, and that the accommodation complies with all legal and habitability regulations applicable in the commune and country where it is located.
Tenant Users: by making a booking or contact request, you declare that the information provided (including identity, nationality and contact details) is true and that you will use the accommodation in accordance with the terms established by the Landlord and with applicable laws.
4.1. To access certain functionalities (such as publishing properties, making reservations or managing contracts), you must create an account with a valid email address and a password.
4.2. You are solely responsible for maintaining the confidentiality of your account and for all activities that occur under it. You must notify us immediately of any unauthorized use.
4.3. Portal Exchange reserves the right to suspend or cancel accounts that contain false or incomplete information or that violate these T&Cs.
5.1. Landlords may publish their accommodations free of charge (or according to fees that will be communicated in due course), describing the characteristics, conditions and house rules.
5.2. Portal Exchange reserves the right to review, approve or reject any publication that does not meet our quality, safety or legality standards. In particular, we may remove those that contain abusive clauses, false information or that could harm the reputation of the Platform.
5.3. Landlords are responsible for keeping the information about their accommodations up to date and truthful.
6.1. Bookings: Through the Platform, Tenants may send booking requests for defined periods. The booking shall be deemed confirmed when the Landlord accepts it and, where applicable, the corresponding payment has been made.
6.2. Contracts: For bookings, the Platform provides tools for generating a standard contract and internal regulations, which may be signed electronically. Such contract is entered into directly between Landlord and Tenant. Portal Exchange is not a party to that contract and assumes no responsibility for the performance of the contractual obligations between the parties.
6.3. Payments: To the extent that payment gateways are incorporated into the Platform, Portal Exchange may act as a collection agent on behalf of the Landlord. In such case, funds will be received into a Platform account and then transferred to the Landlord within the established timeframes, after deduction of applicable commissions. Payment management will be governed by additional terms that will be made available to users.
6.4. Commissions: Portal Exchange may charge commissions to Landlords and/or Tenants for the use of certain functionalities (bookings, payment processing, optional management). Such commissions will be clearly communicated before acceptance.
Landlords:
Deliver the accommodation in the agreed conditions, with the furniture and services offered.
Comply with all applicable legal, tax and safety obligations.
Be directly liable to the Tenant for any breach, damage or loss.
Tenants:
Use the accommodation with due care.
Pay the rent and any other agreed costs on time.
Respect the house rules established by the Landlord.
Both:
Act in good faith, with respect and without engaging in conduct that could harm the reputation of the Platform.
8.1. All content on the Platform (texts, designs, logos, software, images) is the property of Portal Exchange or its licensors and is protected by intellectual property laws.
8.2. Users retain ownership of the information and photographs they upload about their accommodations or profiles. By publishing on the Platform, they grant Portal Exchange a non-exclusive, royalty-free, worldwide license to reproduce, display and distribute such content, solely for the purpose of operating and promoting the Services.
8.3. It is forbidden to extract, copy or use any content of the Platform for commercial purposes without express authorization.
Portal Exchange acts solely as a technological intermediary. Accordingly:
We do not guarantee the truthfulness, completeness or accuracy of the information published by users.
We are not responsible for any damages, losses or breaches that may arise between Landlords and Tenants.
We do not guarantee the continuous availability of the Platform, although we will make reasonable commercial efforts to maintain its operation.
In no event shall Portal Exchange be liable for lost profits, indirect damages or losses arising from the use or inability to use the Services.
The collection and processing of personal data is governed by our Privacy Policy, available on the website. By using the Platform, you consent to such processing in accordance with applicable law, in particular Law No. 19.628 on the Protection of Private Life in Chile.
Portal Exchange reserves the right to update or modify these T&Cs at any time. Modifications will be published on the website indicating the date of the latest version. Continued use of the Platform after the changes take effect shall constitute acceptance of those changes.
We may suspend or cancel your account, temporarily or permanently, without prior notice, in the following cases:
Breach of these T&Cs.
Fraudulent conduct or conduct that could harm other users or the Platform.
By virtue of a legal provision or order from an authority.
Termination shall not affect rights and obligations that arose prior to termination, in particular confirmed bookings.
These T&Cs are governed by the laws of the Republic of Chile. Any dispute arising out of their interpretation or performance shall be submitted to the ordinary courts of justice of Santiago, Chile, with express waiver of any other jurisdiction that might correspond.

The Platform is under continuous development. In future versions, we may incorporate:
Online payment gateway.
Optional management service for landlords.
Verified ratings and reviews system.
Loyalty or referral programs.
Other new functions or categories, among others.
In each case, changes will be notified and, if they involve modifications to these T&Cs, a new version will be published.
